1. Acceptance of Terms
By creating an account or using Sulu, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the app.
We may update these Terms from time to time. If we make material changes, we will notify you at least 14 days in advance via email or in-app notification. If you do not accept the updated Terms, you may delete your account and stop using the app at no penalty. Changes do not apply retroactively to data already collected. Continued use of Sulu after the notice period constitutes acceptance of the updated Terms.
2. Medical Disclaimer
Sulu is a non-diagnostic wellness tracking tool based on self-reported data. It is not a medical device, therapeutic good, or registered product under the Therapeutic Goods Act 1989 (Cth). It is not registered with the Therapeutic Goods Administration (TGA).
Sulu does not diagnose medical conditions, provide medical advice, or recommend treatments. All reports, trends, and summaries generated by the app are based entirely on information you enter — they may be incomplete or inaccurate and do not constitute clinical assessment, diagnosis, or treatment recommendations. Always consult a qualified healthcare professional before making any health-related decisions.
If you are experiencing a mental health crisis or medical emergency, contact emergency services (000) or Lifeline (13 11 14) immediately. Sulu is not a substitute for crisis support.
3. Limitation of Liability
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, statutory right, or remedy you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot lawfully be excluded, restricted, or modified.
To the extent permitted by law, our liability for breach of any non-excludable consumer guarantee is limited, at our option, to:
- re-supplying the service; or
- paying the cost of having the service re-supplied.
For all other claims, our total aggregate liability to you is limited to the fees you have paid to Pow Solutions in the 12 months preceding the claim.
We are not liable for any health decisions, outcomes, or indirect, incidental, or consequential damages arising from your use of Sulu, except to the extent such liability cannot be excluded under Australian law.
4. Subscriptions and Payments
Sulu offers optional paid subscriptions (“Sulu Premium”). Before purchase, the app displays the subscription price, billing frequency, and included features.
Key terms
- Auto-renewal: Subscriptions renew automatically at the end of each billing period. To avoid renewal, cancel before the store or payment provider processes the next charge.
- Cancellation: You may cancel at any time. Cancellation takes effect at the end of the current billing period — you retain access to Premium features until then.
- Refunds: Refunds are handled according to the policies of the platform you purchased through (Apple App Store, Google Play, or Stripe). Your rights under Australian Consumer Law are not affected.
- Free trials: If a free trial is offered, the trial duration and what happens at trial end are disclosed before you start. If you do not cancel before the trial ends, your subscription will convert to a paid plan at the displayed price.

5. Data Processing and Privacy
Your data is governed by our Privacy Policy, which forms part of these Terms. Please read it carefully.
Before collecting any health data, Sulu presents a separate consent screen that identifies the categories of sensitive information collected and how it is used. This express consent is obtained independently from your acceptance of these Terms, as required by Australian Privacy Principle 3.3.
Key points
- We collect self-reported health information including symptoms, severity ratings, cycle data, lifestyle factors, age, menopause stage, and HRT status.
- This data is used solely to provide the Sulu service — your personal timeline, trend charts, and reports.
- We do not sell your data to third parties.
- Your data is stored on cloud infrastructure which may involve servers located outside Australia. Our Privacy Policy details the safeguards in place for cross-border data transfers.
- We retain your data for as long as your account is active. After account deletion, primary data is removed after a 7-day grace period; backup copies are purged within 30 days.
- You have the right to access, correct, export, and delete your personal information. To exercise these rights, use the in-app Profile screen or contact us at support@suluapp.com.
6. User Responsibilities
- You must be at least 18 years old to use Sulu.
- You are responsible for the accuracy of the information you enter and for maintaining the security of your account credentials.
- Do not use Sulu for medical emergencies — contact your local emergency services (000) instead.
- You agree not to misuse the service, attempt to gain unauthorised access to our systems, or use Sulu for any unlawful purpose.
7. Intellectual Property
All content, design, trademarks, and code in Sulu are owned by or licensed to Pow Solutions Pty Ltd. You retain ownership of the data you enter.
You may not copy, modify, distribute, reverse-engineer, or create derivative works from any part of the app without our prior written consent, except to the extent permitted by applicable law.
8. Account Termination and Data
By you
You may delete your account at any time from the Profile screen. Before deletion, you can export your data (CSV) from the Profile screen. Upon deletion request, your primary account data will be removed after a 7-day grace period. During this period, you can sign back in to cancel the deletion. Limited residual copies may be retained in backups for up to 30 days, and where required by law, for fraud prevention, or to resolve disputes.
By us
We may suspend or terminate accounts for breach of these Terms, fraud, abuse, legal risk, or security incidents. We will provide reasonable notice where practicable and a contact path to discuss the decision (support@suluapp.com).
Effect of termination
Active subscriptions will be cancelled and no further charges will apply. You will lose access to Premium features immediately upon termination by us, or at the end of the current billing period for voluntary cancellation.
9. Dispute Resolution
We will attempt to resolve any disputes in good faith. If you have a concern, please contact us at support@suluapp.com.
If a dispute cannot be resolved directly, you may pursue remedies through:
- The Australian Competition and Consumer Commission (ACCC)
- Your state or territory consumer protection agency (e.g., NSW Fair Trading)
- A court of competent jurisdiction in Australia
Nothing in these Terms limits your rights under the Australian Consumer Law or prevents you from making a complaint to the Office of the Australian Information Commissioner (OAIC) regarding the handling of your personal information.
10. Indemnification
You agree to indemnify and hold harmless Pow Solutions Pty Ltd, its officers, employees, and affiliates from claims, damages, or expenses arising from:
- your wilful misconduct or fraudulent use of the app;
- your violation of these Terms; or
- your infringement of any third-party rights.
This indemnification does not apply to the extent that a claim arises from our own negligence, breach of these Terms, or breach of Australian Consumer Law.
11. Children's Data
Sulu is not intended for users under 18. If we become aware that a person under 18 has provided personal information, we will delete it promptly. We do not knowingly collect data from minors. If you believe a minor has created an account, please contact us at support@suluapp.com.
12. Accessibility
We strive to make Sulu accessible to all users. If you encounter accessibility barriers, please contact us at support@suluapp.com. We welcome feedback and are committed to improving the accessibility of our service.
13. Governing Law
These Terms are governed by the laws of New South Wales, Australia. You consent to the non-exclusive jurisdiction of the courts of New South Wales for any dispute not resolved under Clause 9.
